The thread I got that pic from, there's one in glass in there. Thankfully that sort of thing doesn't seem to be nearly so prevalent as it was in Oblivion
I've had similar happen to me. I was wearing the Arch-mage robes, I had Argis the Bulwark with me in full Daedric, and this little Khajiit in fur armor tried mugging me. At what point would anyone thing that was a good idea?
I'm sure "what was I thinking?" crossed his mind after he was shouted off the mountain trail and over the cliff.

The random encounter thieves may wear "good" armor when you come across them (i.e., level scaled to some degree), but I think it's only those scripted sequences. Everything else, like bandits, seem to only scale within a limited range (up to steel, etc).

I've not ran into a thief once yet, though a bounty hunter did rush up to me and demand, erm... zero septims.
Something I feel is a hell of a missed opportunity:
SpoilerAn early quest where a Redquard woman claims she's being hunted by assassins for speaking out against the Aldmeri Dominion and asks me to poke them all with my sword. The assassins then claim they're not really assassins and that the woman in question sold out her noble family to the Dominion. Trying to semi-wildly guess at who is telling the truth on the spot isn't really the wisest thing anybody wants to be doing, but for some reason that never occurred the game's writers.
SpoilerThe love triangle in Riverwood. I should have stabbed both Faendal and Sven in the face after the game dictated that I couldn't tell Camilla that they were both guilty of the same false-letter antics. But, for some reason I decided against it.

SpoilerI sold her out. Kematu's story sounded more believable. Also, it was hilarious to see the first use of a Paralyze spell on her when captured.
